中华传统文化与国际人权法的一致性

  中华古代文化中没有“人权”概念,但不是没有人权的实质内容。传统的民本思想是中国古代人权保护的理论基础并且至今仍有重要影响。在西方的权利理论传入中国之前,在中华传统文化背景之下,中国古代总体上实现了个人的基本权利保护。中华优秀法律文化传统对当代中国的人权保护仍然具有积极意义。中华优秀文化传统不仅不妨碍中国履行根据国际人权法承担的义务,而且有助于防止某些极端或不和谐现象的发生。近百年来,中华传统文化不断推陈出新,向着更有利于人权保护的方向演变。中华传统文化的某些元素已经融入了国际人权法,中国根据国际人权条约制定或修改国内法,间接地借鉴了包括源自西方文化的人权理念和制度在内的人类优秀文化成果。由于中华传统文化与国际人权法本质上的一致性,二者不仅是相容的,而且可以是相补益的。人权是人类社会的普遍价值,但人权普遍性与特殊性是并存的,中国的人权事业是有中华文化特色的。

The Consistency of Chinese Traditional Culture and
International Human Rights Law

  There is no “human rights” concept in Chinese ancient culture, but it does not mean that there is no concrete substance about human rights. The traditional ideology of people-orientation served as the basis of human right protection in ancient China, which remains substantially influential today. Before the introduction of western theory of human rights into China, the protection of basic individual human rights was generally realized in ancient China in accordance with traditional Chinese culture. The excellent traditional Chinese legal culture is still playing active role in terms of human rights protection in current China. The excellent Chinese cultural tradition does not hinder China from implementing its obligations under international human rights law. Conversely, it is helpful to prevent the occurrence of some extreme or disharmonious phenomena. During the last century, traditional Chinese culture has been bringing forth the new through the old and evolving in the direction of favoring human rights protection. Some elements of Chinese culture have been incorporated into international human rights law. China, through enacting or amending its domestic laws in accordance with international human rights law, has indirectly borrowed the fruits of human civilization, including the human rights conception and institutions, originated from western culture. Since Chinese culture and international human rights law are consistent in essence, they are not only tolerable, but also complementary. Human rights are the universal value of human society. But this universality and the particularity of Chinese cultural are coexistent and the course of human rights in China is featured with traditional Chinese culture.
